TERMS AND CONDITIONS OF USE FOR HAYARTE

These terms and conditions create a contract between you and ERIC GABRIEL SALDIVAR AGUILAR, to whom we shall henceforth refer to by the trade name “EGSYSTE”, domiciled at CALLE DAVID BERLANGA #760 B, COLONIA TOPOCHICO, in the city of SALTILLO, of the State of COAHUILA DE ZARAGOZA, in the country of the UNITED MEXICAN STATES, administrator and owner of the “HAYARTE” PLATFORM.

Please ensure that you read these TERMS AND CONDITIONS carefully in order to understand the conditions under which the HAYARTE service is provided. It is necessary to accept the following in order to be able to use HAYARTE. At the same time, using HAYARTE will be regarded as acceptance of these.

HAYARTE

  1. The HAYARTE platform is a mobile and web application designed, developed, and administered by EGSYSTE, for the purpose of quick and easy searching of cultural and artistic events close to the geographic location of the users. It may be mentioned henceforth as “the application” or “the platform”.
  2. USERS can use HAYARTE at no cost for searching for cultural and/or artistic events, accessing it via mobile device or web page.
  3. USERS can make use of the HAYARTE image for the advertising purposes as long as they do not cause economic and/or moral damages for the brand, its image, HAYARTE or EGSYSTE.
  4. The disputes generated from using HAYARTE will be settled in the courts with jurisdiction of the city of Saltillo, Coahuila of the UNITED MEXICAN STATES.

THE USERS

  1. EGSYSTE recognises as USERS those persons who, upon accessing the platform through any of its recognised mediums (mobile application and web page) and who have first accepted these TERMS AND CONDITIONS OF USE.
  2. USERS may be divided into two categories:
    1. FINAL USER: Any person with an electronic device capable of installing and using HAYARTE, for the purpose of finding artistic and cultural events being held close to their own or any other location.
    2. ARTIST AND/OR CULTURAL PROMOTER: Any person over 13 years of age who, in addition to installing and using HAYARTE, registers an account providing information such as NAME AND EMAIL ADDRESS, for the purpose of advertising and disseminating cultural and/or artistic events.
  3. The ARTIST AND/OR CULTURAL PROMOTER must register an account in the HAYARTE web page with real data.
  4. All the information supplied by the ARTIST AND/OR CULTURAL PROMOTER within the PLATFORM will be presumed to be true by EGSYSTE, as well as by the USERS of HAYARTE. The ARTIST AND/OR CULTURAL PROMOTER shall be the responsible party in the case of entering and/or publishing incorrect or non-existent information which causes uncertainty for the FINAL USERS. Publication of incorrect or non-existent information may be grounds for a report generated by the FINAL USERS, as well as having as a consequence the EVENT advertisement being withdrawn without any type of reimbursement, as well as the temporary or definitive removal of the account of the ARTIST AND/OR ARTS PROMOTER.

THE EVENTS AND THEIR PUBLICATION

  1. HAYARTE is a platform designed for the purpose of promoting the artistic and cultural development of the community around the USER, due to which only public artistic and/or cultural events shall be accepted. EGSYSTE reserves the right to catalogue the event as artistic and/or cultural.
  2. For the advertisement of cultural events, THE ARTIST AND/OR CULTURAL PROMOTER must:
    1. Provide the HAYARTE platform the following information:
      1. The geographical location of the event only and exclusively via the HAYARTE mobile application;
      2. Written information of the place name and its address;
      3. The name of the event;
      4. A PROMOTIONAL IMAGE for the event, if applicable;
      5. Description of the event;
      6. Date and time it will occur;
      7. CLASSIFICATION of ages and type of audience it is intended for, in accordance with the local laws and customs (for example, 18+), and
      8. COST of entry to the event, if applicable.
    2. As well as paying the cost for publishing of the event, which is calculated by the platform.
  3. The PROMOTIONAL IMAGE for the events must always be suitable for all audiences, regardless of its (the event’s) classification.
  4. The ARTIST AND/OR CULTURAL PROMOTER shall be the only party responsible for the content of the images uploaded as the PROMOTIONAL IMAGE of the events.
  5. Publication of the EVENTS must avoid the use of offensive, discriminatory, or sexual language, images, or expressions, or of any other nature contrary to good morals, in its DESCRIPTION as well as its PROMOTIONAL IMAGE. EGSYSTE reserves the right to classify the content of the EVENT as inadequate material based on their own criteria and the reports made by the users of the application.
  6. The ARTIST AND/OR CULTURAL PROMOTER commits to register the real COST of entry to the event, if applicable, in the event information to be advertised
  7. The ARTIST AND/OR CULTURAL PROMOTER must report any changes to the information of the advertisement, as well as a possible cancellation of the EVENT, via the HAYARTE web page: https://hayarte.app.
  8. The EVENTS on the platform must be classified by ages and/or type of audience they are aimed at which are applicable according to the laws, traditions, or good morals of the place where it is carried out. It is the sole responsibility of the ARTIST AND/OR CULTURAL PROMOTER to know and record this information at the time of registering the event.
  9. The ARTISTS AND/OR CULTURAL PROMOTERS shall be responsible for guaranteeing access to and security of the place where the event will take place. EGSYSTE will not be liable for any damage caused by the poor management of the event or the conditions of the place where it will take place.

  10. Advertising an EVENT on HAYARTE will have a cost at the expense of the ARTIST AND/OR CULTURAL PROMOTER. HAYARTE will show the ARTIST AND/OR CULTURAL PROMOTER the final amount to pay for the advertisement, calculated by the platform in accordance with the information of each EVENT. Payment of the amount for the advertisement will be made through a third party called the PAYMENT MANAGEMENT COMPANY accessible via the HAYARTE portal as part of the advertising process of the EVENT
  11. The cost of the advertisement of the event on HAYARTE covers up to 7 (seven) calendar days, always ending on the date of the event; in the event that payment is credited in a time less than 7 (seven) days, it will only cover the period between the moment the payment is credited and the day of the event. (For example, if there are three days left until your event, the advertisement will be available from the moment payment is credited until the day of the event.)

CONTENT OF THE ADVERTISEMENTS

  1. USERS will have the right and obligation to report any event advertised on HAYARTE that contravenes and violates the clauses relating to the EVENTS in this document.
  2. EGSYSTE will be responsible for the analysis of the reports generated by the USERS regarding the events advertised. The ARTISTS AND/OR CULTURAL PROMOTERS will be notified of the reports.
  3. Any ARTIST AND/OR CULTURAL PROMOTER who receives 3 (three) reports will be issued with a warning from EGSYSTE. In said warning they will be notified, through the most relevant channel, about the revision carried out as well as the changes and/or suggestions to the advertisement for the purpose of complying with these terms and conditions of use.
  4. At the time that an ARTIST AND/OR CULTURAL PROMOTER accumulates 3 (three) warnings in a period of less than 6 (six) months counting from the date on which the first warning was made, they will be subject to temporary or definitive suspension, as EGSYSTE sees fit.
  5. EGSYSTE will remove any advertisement whose promotional image infringes on fraction III of THE EVENTS section of these terms and conditions.
  6. The advertisements which are removed due to non-compliance with THE EVENTS section will not be credited with reimbursement or compensation.
  7. The advertisements should only include content that you have created or that are licensed to use or may be removed without refund.
  8. Clarification and rectification of the warnings given to ARTIST AND/OR CULTURAL PROMOTER will be made through the following email address admin@egsyste.me

THESE TERMS AND CONDITIONS

  1. EGSYSTE reserves the right to modify these TERMS AND CONDITIONS without the consent of the USER, however, any type of alteration, modification, and transformation may be communicated to the registered users through their email and published on the platform’s web page, and through the following link: https://hayarte.app/about/term/

TÉRMINOS Y CONDICIONES DE USO DE HAYARTE

Estos términos y condiciones crean un contrato entre usted y ERIC GABRIEL SALDIVAR AGUILAR, a quien en adelante nos referiremos por el nombre comercial “EGSYSTE”, con domicilio en CALLE DAVID BERLANGA #760 B, COLONIA TOPOCHICO, en la Ciudad de SALTILLO, del Estado de COAHUILA DE ZARAGOZA, en el país ESTADOS UNIDOS MEXICANOS, administrador y dueño de la PLATAFORMA “HAYARTE”.

Por favor, asegúrese de leer estos TÉRMINOS Y CONDICONES con detenimiento para entender las condiciones en las que se presta el servicio de HAYARTE. Aceptar los siguientes es necesario para poder utilizar HAYARTE. Al mismo tiempo, el uso de HAYARTE se entenderá como aceptación de los mismos.

DE HAYARTE

  1. La plataforma HAYARTE es una aplicación móvil y web diseñada, desarrollada y administrada por EGSYSTE, con la finalidad de la búsqueda rápida y fácil de eventos culturales y artísticos cercanos a la ubicación geográfica de los usuarios. En adelante puede ser mencionada como “la aplicación” o “la plataforma”.
  2. Los USUARIOS podrán utilizar HAYARTE sin costo alguno para la búsqueda de eventos culturales y/o artísticos, accediendo a la misma por medio de un dispositivo móvil o la página web.
  3. Los USUARIOS podrán hacer uso de la imagen de HAYARTE con fines publicitarios siempre y cuando no se ocasionen daños y perjuicios económicos y/o morales para la marca, su imagen, HAYARTE o EGSYSTE.
  4. Las controversias generadas a partir del uso de HAYARTE serán dirimidas en los tribunales con jurisdicción de la ciudad de Saltillo, Coahuila de los ESTADOS UNIDOS MEXICANOS.

DE LOS USUARIOS

  1. EGSYSTE reconoce como sus USUARIOS a aquellas personas que, al acceder a la plataforma por cualesquiera de sus medios reconocidos (Aplicación móvil y página web) y que aceptan en primer momento los presentes TÉRMINOS Y CONDICIONES DE USO.
  2. Los USUARIOS pueden dividirse en dos categorías:
    1. USUARIO FINAL: Es toda persona con un dispositivo electrónico capaz de instalar y usar HAYARTE, con el fin de encontrar los eventos artísticos y culturales que se desarrollen cerca de su ubicación o cualquier otra.
    2. ARTISTA Y/O PROMOTOR CULTURAL: Es toda persona mayor de 13 años, que, además de instalar y usar HAYARTE, registra una cuenta proporcionando datos tales cómo NOMBRE Y CORREO ELECTRÓNICO, con la finalidad de publicitar y difundir eventos culturales y/o artísticos.
  3. El ARTISTA Y/O PROMOTOR CULTURAL deberá registrar una cuenta en la página web de HAYARTE con datos reales.
  4. Toda la información suministrada por el ARTISTA Y/O PROMOTOR CULTURAL dentro de la PLATAFORMA será presumida cierta por EGSYSTE, así como por los USUARIOS que utilicen HAYARTE. El ARTISTA Y/O PROMOTOR CULTURAL será el responsable en caso de ingresar y/o publicitar información errónea o inexistente que cause incertidumbre en los USUARIOS FINALES. La publicación de información errónea o inexistente podrá ser motivo de un reporte generado por los USUARIOS FINALES, además de tener como consecuencia que se retire la publicación del EVENTO sin ninguna clase de reembolso, así como la baja temporal o definitiva de la cuenta del ARTISTA Y/O PROMOTOR DE ARTE.

DE LOS EVENTOS Y SU PUBLICACIÓN

  1. HAYARTE es una plataforma diseñada con la finalidad de fomentar el desarrollo artístico y cultural de la comunidad cercana al USUARIO, por lo que, solamente serán aceptados los eventos públicos artisticos y/o culturales. EGSYSTE se reserva el derecho a catalogar el evento cómo artístico y/o cultural.
  2. Para la publicitación de eventos culturales El ARTISTA Y/O PROMOTOR CULTURAL deberá:
    1. Proporcionar a la plataforma HAYARTE la siguiente información:
      1. La ubicación geográfica del evento a través, única y exclusivamente, de la aplicación móvil de HAYARTE;
      2. Datos escritos del nombre del lugar y la dirección de este;
      3. El nombre del evento;
      4. Una IMAGEN PROMOCIONAL del evento en caso de haberla;
      5. Descripción del evento;
      6. Fecha y horario en que este ocurrirá;
      7. La CLASIFICACIÓN de edades y tipo de público al que está dirigido, de acuerdo a las leyes y costumbres locales (por ejemplo 18+), y
      8. El COSTO de las entradas al evento en caso de haberlo.
    2. Además de pagar el costo de publicación del evento, el cual es calculado por la plataforma.
  3. La IMAGEN PROMOCIONAL de los eventos deberá ser siempre apta para todo el público independientemente de la clasificación del mismo(evento).
  4. El ARTISTA Y/O PROMOTOR CULTURAL será el unico responsable de el contenido de las imágenes subidas como IMAGEN PROMOCIONAL de los eventos.
  5. La publicación de EVENTOS deberá evitar el uso lenguaje, imágenes, o expresiones ofensivas, discriminatorias, sexuales o de cualquier índole que vaya en contra de las buenas costumbres, tanto en su DESCRIPCIÓN como en su IMAGEN PROMOCIONAL. EGSYSTE se reserva el derecho a clasificar el contenido del EVENTO como material inadecuado basándose en su propio criterio y los reportes levantados por los usuarios de la aplicación.
  6. EL ARTISTA Y/O PROMOTOR CULTURAL se compromete a registrar en los datos del evento a publicitar el COSTO real de las entradas al evento en caso de haberlo.
  7. El ARTISTA Y/O PROMOTOR CULTURAL deberá informar a través de la página web de HAYARTE: https://hayarte.app, utilizando su cuenta, cualquier cambio en la información de la publicación, así como una posible cancelación del EVENTO.
  8. Los EVENTOS en la plataforma, deberán ser clasificados por edades y/o tipo de público al que van dirigidos que sean aplicables de acuerdo a las leyes, tradiciones y buenas costumbres del lugar dónde se realice. Es únicamente responsabilidad del ARTISTA Y/O PROMOTOR CULTURAL conocer y capturar esta información al momento de registrar el evento.
  9. Los ARTISTAS Y/O PROMOTES CULTURALES tendrán la responsabilidad de garantizar el acceso y la seguridad del lugar donde se realizará el evento. EGSYSTE no se responsabiliza de cualquier siniestro que se ocasione por el mal manejo del evento o las condiciones del lugar dónde se llevará acabo.

  10. Publicar un EVENTO en HAYARTE tendrá un costo a cargo del ARTISTA Y/O PROMOTOR CULTURAL. HAYARTE mostrará al ARTISTA Y/O PROMOTOR CULTURAL el monto final a pagar por la publicación, calculado por la plataforma de acuerdo a la información de cada EVENTO. El pago del monto de publicación será realizado a través de un tercero denominado EMPRESA DE GESTIÓN DE PAGOS accesible por medio del portal de HAYARTE, como parte del proceso de publicación del EVENTO.
  11. El costo de publicación del evento en HAYARTE cubre hasta 7(siete) días naturales finalizando siempre en la fecha del evento, en caso de que el pago se acredite faltando un tiempo menor a los 7(siete días) solo cubrirá el periodo entre el momento de acreditación del pago y el día del evento. (Por ejemplo; si faltan tres días para tu evento la publicación estará disponible desde el momento en que se acredite el pago hasta el día del evento).

DEL CONTENDIO DE LAS PUBLICACIONES

  1. Los USUARIOS tendrán el derecho y la obligación de reportar todo evento publicado en HAYARTE que contravenga y viole las cláusulas referentes a los EVENTOS en el presente.
  2. EGSYSTE será el responsable del análisis de los reportes generados por los USUARIOS con respecto a eventos publicados. Los reportes serán notificados a los ARTISTAS Y/O PROMOTORES CULTURALES.
  3. El ARTISTA Y/O PROMOTOR CULTURAL que reciba 3 (tres) reportes será acreedor de una advertencia por parte de EGSYSTE. En dicha advertencia se le notificará, por el medio más pertinente, acerca de la revisión realizada así como los cambios y/o sugerencias a la publicación con el fin de que cumpla con el presente términos y condiciones de uso.
  4. Al momento en el que un ARTISTA Y/O PROMOTOR CULTURAL acumule 3 (tres) advertencias en un periodo menor a 6 (seis) meses contados a partir de la fecha en que se realizó la primera advertencia, será sometido a la suspensión temporal o definitiva de su cuenta, según convenga EGSYSTE.
  5. EGSYSTE dará de baja cualquier publicación cuya imagen promocional infrinja con la fracción III. del apartado DE LOS EVENTOS del presente términos y condiciones.
  6. Las publicaciones que sean removidas por incumplimiento al apartado DE LOS EVENTOS no serán acreedoras a reembolsos ni compensaciones.
  7. Las publicaciones solo deberá incluir contenido que haya creado o que tenga una licencia para usar o podrán ser removidas sin algun rembolso.
  8. El proceso de aclaración y rectificación de advertencias hechas a EL ARTISTA Y/O PROMOTOR CULTURAL se realizará por medio de la siguiente dirección de correo electrónico admin@egsyste.me

DE ESTOS TÉRMINOS Y CONDICIONES

  1. EGSYSTE se reserva el derecho a la modificación de los presentes TERMINOS Y CONDICIONES sin el consentimiento del USUARIO, sin embargo, todo tipo de alteración, modificación y transformación podrá ser comunicado a los usuarios registrados a través de su correo electrónico y publicados en la página web de la plataforma y a través del enlace https://hayarte.app/about/term/
